Yanalangami is a recognition and awards program that celebrates
Indigenous female Changemakers in Australia who are making a positive
impact on Community.
Individuals can self-nominate or be nominated by their Community with 16 finalists (8 Emerging and 8 Community Changemakers) being awarded a place in Tranby’s Yanalangami Online Leadership and Empowerment Program.
TERMS AND CONDITIONS FOR YANALANGAMI: STRONG WOMEN, STRONG COMMUNITIES PROGRAM 2024
1. TERMS AND CONDITIONS
1.1. The terms and conditions of the Yanalangami: Strong Women, Strong Communities Program
2024 (“Program”) comprise:
a. these terms and conditions; and
b. the online nomination forms to be completed by the Applicant (for self-nomination) or
the Nominator (for Community Nomination), available at www.yanalangami.com.au
(“Nomination Form”)
(together, “Terms and Conditions”).
1.2. By participating in the Program, Participants agree to be bound by the Terms and
Conditions.
1.3. In these Terms and Conditions,
a. “Nominee” means a person, including an Applicant, who has been nominated on a
Nomination Form to be an Emerging Changemaker or a Community Changemaker.
b. “Nominator” means a person who has completed a Nomination Form, but is not a
Nominee, and makes a nomination under clause 3.1.
c. “Applicant” means a person who has completed a Nomination Form and names
themselves as a Nominee on that form under clause 3.2.
d. “Participants” means Nominees, Nominators and Applicants.
e. “Finalists” means a person who has been selected
2. OVERVIEW OF THE PROGRAM
Subject to the Terms and Conditions:
2.1. the Program is administered by the Tranby Aboriginal Co-operative Limited (“Tranby”).
2.2. The Program consists of two categories:
a. the Emerging Changemaker Category, and
b. the Community Changemaker Category
2.3. the intent of the Program is to discover and celebrate Aboriginal and Torres Strait Islander women who are making a positive impact in community. The program aims to recognise and promote community role models whose work or activities create a positive benefit for others in various ways, including but not limited to: advancing the status of women and girls; creating civic engagement; violence prevention; nurturing a sense of belonging and
inclusion; help build community resilience; promoting positive health and wellbeing; improving access to Community services and groups; protecting and caring for the local environment. The program aims to provide an opportunity for the Finalists to enhance their leadership and governance skills through culturally meaningful and community relevant training via online workshop programs as well as mentoring and project support. The workshop series seeks to strengthen leadership capacity, foster good governance, civic engagement, mentorship and sustainable grassroots change.
2.4. to be eligible, Nominees must be an Aboriginal and/or Torres Strait Islander woman who currently lives in Australia. The Program is inclusive and welcomes Trans Women.
2.5. Nominees must also demonstrate that they are individuals who are (or seek to) create positive, grassroots and sustainable change within and for Community and support the intent of the program as outlined in 2.3.
2.6. the nomination process commences at 9am (AEST) on 8 March 2024 and nominations close 5pm (AEST) on 31 March 2024 (“Nomination Period”). Tranby may, at its absolute discretion, extend the Nomination Period.
2.7. the selection of Finalists will be by the members of the Aboriginal Advisory Committee (“AAC”) engaged by Tranby to oversee the Program, including selecting Finalists. The selection will take place between 1 April 2024 and 10 April 2024 (“Selection Period”). Tranby may, at its absolute discretion, extend the Selection Period.
2.8. up to 8 Finalists who, in the absolute discretion of the AAC, meet the Selection Criteria for “Emerging Changemaker” will be awarded the title “Emerging Changemaker Finalist” and will receive a place in Tranby’s Yanalangami Online Leadership and Empowerment Program for Emerging Changemakers.
2.9. up to 8 Finalists who, in the absolute discretion of the AAC, meet the Selection Criteria for “Community Changemaker” will be awarded the title “Community Changemaker Finalist” and will receive a place in Tranby’s Yanalangami Online Leadership and Empowerment Program for Community Changemakers.
3. WHO CAN NOMINATE?
3.1. Subject to the Terms and Conditions, any person aged 17 and over (Nominator) may nominate a Nominee to be an Emerging Changemaker or Community Changemaker.
3.2. A person aged 17 and over can nominate themselves to be an Emerging Changemaker or Community Changemaker (Applicant).
4. WHO CAN BE NOMINATED OR APPLY?
4.1. A Nominator may nominate any person (including themselves, as an Applicant) who meets each of the following criterion to be a nominee (Nominee) in the Program:
a. To be eligible, Nominees must meet the standards set out in sections 2.3 and 2.4. The Nominee’s actions or work must, in the opinion of the Program’s AAC, positively impact community.
b. For a Nominee to be eligible for the Program, the Nominee must be an Aboriginal and/or Torres Strait Islander woman or trans woman currently living in Australia. The Nomination must demonstrate, to the AAC’s complete satisfaction, that the Nominee meets the above criteria. Should the above requirements not be met, Tranby and/or the AAC reserves the right in its absolute discretion to refuse to accept the Nomination.
c. Nominees for the Emerging Changemaker category must be between the ages of 17-24 at the date on which the nomination is submitted.
d. Nominees for the Community Changemaker category must be 25 years old or older at the date on which the nomination is submitted.
e. Nominators must have permission from the Nominee to:
i. nominate them into the Program; and
ii. provide their personal information, including their name, email address, telephone number and Aboriginal and/or Torres Strait Islander status to
Tranby, and the Nominator must disclose to the Nominee that Tranby may contact the Nominee in respect of the Nomination.
f. the Nominee’s work or activities for which they are nominated in the Program must not be for the benefit of any overseas programs and projects, including international good will agencies or if the Nominee is the primary beneficiary, not the Community.
4.2. Employees of Tranby are not eligible to be a Nominee.
4.3. Tranby reserves the right to refuse any Nomination due to a conflict of interest which is determinable by Tranby at its absolute discretion.
5. HOW TO NOMINATE AND APPLY
5.1. To enter the Program, Nominators and Applicants must, during the Nomination Period, complete the Nomination Form for a Nominee (a completed Nomination Form is herein referred to as a “Nomination”).
5.2. Tranby and/or the AAC, may at their absolute discretion, accept or reject Nominations which contain errors and/or omissions. Failure by Tranby to enforce any of its rights at any stage does not constitute a waiver of those rights.
5.3. Incomplete or indecipherable Nominations may be deemed invalid at Tranby’s absolute discretion.
5.4. If there is a dispute as to the identity of a Nominator or Nominee or Tranby reserves the right, in its absolute discretion, to determine the identity of that person.
5.5. No responsibility is accepted by Tranby for late, lost or misdirected Nominations (including where a Nomination Form is not received due to any technical difficulties).
6. NOMINATION
6.1. By entering the Program, Participants acknowledge and agree that:
a. the Program is conducted at Tranby’s absolute discretion, and if the Program is not conducted as anticipated due to any reason, Tranby reserves the right, in its absolute discretion, to the full extent permitted by law to:
iii. disqualify any Nomination; or
iv. modify, suspend, terminate or cancel the Program;
b. There may only be one Nominee per Nomination, and that person will be the person nominated in the Nomination Form;
c. Tranby may contact a Participant at any time in relation to the Program during the Nomination Period, Selection Period, and Promotion Period (as applicable);
d. There is no obligation or requirement on Tranby to promote, use or display any information (including Personal Information, as defined in clause 11.1) provided in the Nomination, including but not limited to the Nominee’s name, suburb, state, photo and a description of their change initiative;
e. In entering the Program, the Participants (including Nominators, Applicants and Nominees) will not transfer files (including photos) which contain viruses or other harmful programs;
f. The Nominator has all permissions and consents to enable them to nominate the Nominee including the Nominee’s consent to provide any information referred to at clause 4.1(e) above. If requested by Tranby, the Nominator must provide Tranby with evidence of such consent and permission;
g. Tranby is under no obligation to communicate in any way with a Participant in connection with the Program, including in respect of any Nomination; and
h. Uploading a photo of the Nominee will not infringe the copyright or other rights of any third party, or infringe any applicable laws or regulations.
6.2. Participants acknowledge that by participating in the Program they may, if requested by Tranby, be required to confirm or provide additional information in respect of any Nomination (either by phone, email, Zoom or other video conferencing platform or in
person) to Tranby during the Program.
6.3. By entering the Program, Nominators, Applicants and Nominees represent and warrant that all information provided by them to Tranby in the Nomination or otherwise in connection with the Program is true and correct, and not misleading or deceptive by omission or otherwise.
6.4. Tranby may request proof of a valid Working With Children Check or other State child protection checks for those Nominees who work or engage with children.
6.5. Tranby may request from the Nominee contact details of a referee who Tranby may contact to verify any information contained in the Nomination. The Nominee must obtain all permissions and consents to provide Tranby with the contact details of the referee. If requested by Tranby, the Nominee must provide Tranby with evidence of such consent and permission.
6.6. Referees may be Community Elders, Aunties, corporate partners, government or community agencies or someone who works with or has worked with the Nominee.
6.7. Tranby reserves the right, at any time, in its discretion:
a. to verify the validity of Nominations (including the identities of Participants);
b. to disqualify (at Tranby’s absolute discretion) any Nomination from the Program that is not made in accordance with the Terms and Conditions, which has omissions or which Tranby otherwise deems inappropriate; and
c. to vary these Terms and Conditions, or to cancel, postpone or reschedule the Program.
7. SELECTION PERIOD
7.1. During the Selection Period, Tranby:
a. will review the Nominations to determine the Nominees who are Finalists (Finalists) in the Program. The Review panel is made up of the Program’s AAC;
b. may ask Nominators and Nominees to participate in further interviews or other selection activities to assist in shortlisting Nominees. Nominees must make themselves reasonably available to participate in any such interviews or other selection activities;
c. may conduct reference checks (with the referee nominated by the Nominee under clause 6.5) and/or online open source checks in respect of the Nominee;
d. may, in its absolute discretion, shortlist Nominees as Finalists based on their Nomination, interviews and reference checks conducted by Tranby.
7.2. Upon selection, Finalists’ names, a photograph and information pertaining to the work or activities for which they were nominated will be published on the Tranby and Yanalangami websites, on Tranby and Yanalangami social media and on campus at Tranby in Glebe.
7.3. Tranby reserves the right to commence reviewing Nominations prior to the commencement of the Selection Period.
7.4. Finalists must maintain the confidentiality of their status as a Finalist at Tranby’s direction.
8. AWARD
8.1. In this Program, Finalists will be awarded a place in the Yanalangami Online Leadership and Empowerment Program which will:
a. Provide a 6-week online program for both Emerging Changemaker Finalists and Community Changemaker Finalists to be undertaken together (a total of up to 16 participants); and
b. Provide an additional 4-week Community Changemaker extension program for Community Changemaker Finalists only (up to 8 participants) that includes business coaching.
8.2. Finalists will make themselves reasonably available to participate in any interviews, photography shoots and other activities to produce new content to promote the Program during the Promotion Period. This content will be made publicly available, including online and on social media. All rights, title and interest in any such content will vest with Tranby.
8.3. Notwithstanding any provision of these Terms and Conditions, Tranby reserves the right at any time to:
a. remove a Finalist from the Program for any reason whatsoever, including but not limited to if Tranby determines (at its absolute discretion) that any conduct by the person does not align with the standards and values of Tranby and the Program or otherwise detracts from the goodwill and reputation attached to Tranby and the Program.
9. NOTIFICATION
9.1. Tranby will notify Participants of the Finalists within one month of the end of the Nomination Period (Notification Period) in a manner to be determined by Tranby.
9.2. Upon notification to Participants the Finalists’ names, a photograph and information pertaining to the work or activities (as provided by the Nominee or Applicant) may be published on the Tranby and Yanalangami websites and on Tranby and Yanalangami Program social media.
10. LIABILITY
10.1. Except for any liability that cannot be excluded by law, Tranby (including its officers, employees, agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Program, including, but not limited to, where arising out of the following:
a. the outcome of the Program;
b. any technical difficulties relating to submission or receipt of Nominations;
c. any unauthorized access or third-party interference;
d. any Nomination that is late, lost, altered, damaged or misdirected (as applicable); due to any reason beyond the reasonable control of Tranby;
e. any termination or cancellation of the Program;
f. any variation in the Award program to that stated in the Terms and Conditions;
g. any tax liability incurred by a Finalist.
11. PRIVACY STATEMENT
11.1.1. From 8 March 2024 until 30 April 2024 (“Promotion Period”), Nominators, Nominees, Applicants and Finalists consent to Tranby collecting, using and displaying any information relating to them (including personal information as defined by the Privacy Act 1988 (Cth) (“Personal Information”)) provided in a Nomination or otherwise collected from them during the Program, in any media without remuneration for the purposes of promoting and marketing the Program or any future Strong Women, Strong Communities or Leadership and Empowerment programs.
11.2. Tranby may use and display such information for the abovementioned purposes online (including social media) or on campus at Tranby, or otherwise make public any details of the same, at any time during the Promotion Period.
11.3. All rights, title and interest in any such content created for the purposes of promoting and marketing the Program will vest with Tranby.
11.4. The Personal Information that the Nominator, Nominee or Finalist provide will be collected by Tranby for the purpose of conducting the Program and managed in accordance with the Privacy Act 1988 (Cth). Participation in the Program is conditional on providing this information. Tranby may disclose this Personal Information to its employees, contractors and agents to assist in operating the Program or communicating with Participants.
11.5. If a Participant wishes access or to correct any Personal Information Tranby holds about that person, or to complain about a privacy breach by Tranby, a Participant should contact Tranby at [email protected]
